Advertiser Terms

1. Description of the service
The KotKit platform provides Advertisers (Brands) with the ability to create advertising campaigns to distribute video content on TikTok through the KotKit Market network of creators.
These Terms supplement the general Terms of Use and apply to all Users who use the Advertiser functionality.
2. Creating and managing campaigns
When creating a campaign, the Advertiser specifies:
- • The campaign name and content category
- • Video files with captions and hashtags
- • The campaign budget and the price per publication
- • The target number of publications
- • The minimum number of creator followers (if required)

3. Content moderation
All video materials undergo moderation before distribution. The Platform reserves the right to reject content without explanation.
Prohibited content:
- • Extremist content or content inciting hatred
- • Content that infringes the copyright of third parties
- • False or misleading advertising
- • Content that violates the laws of the Russian Federation or the TikTok Terms
- • Content in categories requiring special verification (without having passed it)
The Platform checks uploaded videos for duplicates. Re-uploading a previously used video may be rejected.
4. Budgeting and payment
- • Prepayment model: the Advertiser tops up the balance; the budget is reserved upon campaign activation
- • Charging: funds are debited from the campaign budget after the successful completion of each task
- • Payment methods: YooKassa (cards, SBP, electronic wallets)
- • Price per post: fixed when the campaign is created and cannot be reduced
- • Budget increase: the Advertiser may increase the budget and the target number of publications
5. Refunds
- • Used budget (tasks already completed) — not refundable
- • Unused budget — may be refunded upon suspension or completion of the campaign
- • Refunds are made using the same method by which the payment was made
6. Intellectual property
The Advertiser retains all rights to the uploaded content (videos, texts, logos).
By creating a campaign, the Advertiser grants the Platform and creators a limited, non-exclusive license to distribute the content solely within the framework of performing campaign tasks on TikTok. The license is valid for the period of the campaign’s activity.
The Advertiser warrants that it holds all the rights necessary for the uploaded content and that its distribution does not infringe the rights of third parties.
7. Advertiser liability
The Advertiser is responsible for:
- • Legality of content — compliance with the laws of the Russian Federation and the TikTok rules
- • The Advertising Law (Federal Law No. 38-FZ) — the accuracy of advertising claims and compliance with advertising requirements
- • Copyright — holding the rights to use and distribute the content
7.1. Mandatory labelling of internet advertising
Since September 2023, all internet advertising in the Russian Federation is subject to mandatory labelling. The Advertiser is obliged to independently ensure:
- • Registration with an ORD (Advertising Data Operator) — to transfer data to the ERIR (Unified Register of Internet Advertising)
- • Obtaining an erid token — the unique identifier of the advertising creative from the ERIR
- • Displaying the labelling in each advertising video: the “Advertising” mark, the name of the advertiser and the erid token
- • Specifying the KKTU (classifier of goods and services categories) when submitting data to the ERIR
- • Payment of the 3% advertising levy on quarterly income from advertising activity (introduced in 2025)
Penalties for labelling violations: RUB 200,000 — 500,000 for legal entities. The Platform bears no responsibility for the absence or incorrect labelling of advertising by the Advertiser.
8. Rating creators
The Advertiser may rate the quality of each task’s completion on a scale from 1 to 5. Ratings affect the creator’s rating and priority in the distribution of future tasks. Ratings must be objective and based on the quality of the work performed.
9. Limitation of the Platform’s liability
The Platform bears no responsibility for:
- The number of views, likes or other TikTok metrics
- TikTok sanctions against creators’ accounts
- Changes to TikTok algorithms affecting content reach
- The commercial result of the advertising campaign
- Campaign completion timelines (depend on creator availability)
