Terms of Use

1. Definitions and terms

“Platform” — the KotKit Market software complex, including the kotkit.pro website and related services.

“Operator” — Дородников Павел Сергеевич (самозанятый, плательщик НПД), ИНН 643908169753. Details and contacts are on the Operator details page.

“User” — any person using the Platform.

“Advertiser” / “Company” / “Brand” — a User who posts campaign briefs on the Platform.

“Creator” / “Performer” — a User who accepts campaign tasks, films and publishes short videos.

“KOTS points” — internal KotKit Market loyalty points. KOTS points are not money, a digital currency, a security or a means of payment. The terms of accrual, limits, minimum thresholds and the procedure for requesting a reward are determined by the rules of the specific campaign.

“Campaign” — a unit of advertising activity created by an Advertiser to distribute content through the Platform.

“Task” — a unit of work within a Campaign: the publication of one short video.

2. Acceptance of terms

By using the KotKit Platform, you agree to these Terms of Use (the “Terms”). If you do not agree with any provisions, stop using the Platform.

Depending on the User’s role, the following also apply to you:

We reserve the right to amend these Terms. By continuing to use the Platform after the changes are published, you accept the updated Terms.

3. Description of the Platform

KotKit Market is a task marketplace for brands and creators. The Platform supports two roles:

For Advertisers

Posting campaign briefs, reviewing publications and a summary report on results

For Creators

Accepting campaign tasks, filming and publishing short videos under the brand’s rules

4. User requirements

To use the Platform you must:

  • • Be over 18 years old or have written consent from parents/guardians
  • • Provide accurate information when registering
  • • Have a valid Google or Telegram account for authorization
  • • Not be subject to international sanctions

A single User may have only one account on the Platform. The User is responsible for the security of their account and the confidentiality of their authorization data.

5. Payment and pricing

The Platform accepts payment via the following methods:

  • • YooKassa — bank cards, SBP, electronic wallets (Russian methods)

Payment data is processed directly by the payment providers. The Platform does not store bank card data. Prices may be changed with 30 days’ notice.

6. Refunds

Refunds are not provided:

  • • In the event of a breach of these Terms
  • • For campaign budget already allocated to completed tasks
  • • For used KOTS loyalty points

For Advertisers: an unused campaign budget may be refunded upon its suspension or completion in accordance with the Advertiser Terms.

7. TikTok warning

Important warning

Publishing content on TikTok is governed by the TikTok Terms of Service. Creators post videos on TikTok in their own name and are responsible for the compliance of their publications with TikTok’s rules on their own.

KotKit provides a task marketplace between Advertisers and Creators. The Platform bears no responsibility for sanctions by TikTok, including restrictions, shadow bans or the blocking of a Creator’s account.

8. Prohibited activities

When using the Platform, the following is prohibited:

  • • Distributing spam, malicious or illegal content
  • • Infringing third-party copyrights
  • • Fraud, manipulation of verification or metrics
  • • Creating multiple accounts
  • • Abusing the referral program (fictitious registrations, collusion)
  • • Attempts at hacking, reverse engineering or modifying the application
  • • Distributing content of an extremist nature or violating the laws of the Russian Federation
  • • Transferring the account or license to third parties

9. Intellectual property

All rights to the KotKit Platform, including code, design, logos and documentation, belong to KotKit and are protected by intellectual property laws.

The User is granted a limited, non-exclusive, non-transferable license to use the Platform in accordance with these Terms.

Content uploaded by an Advertiser as part of campaigns remains the property of the Advertiser. The Advertiser grants the Platform and Creators a limited license to distribute the content within the campaign.

10. Limitation of liability

The Platform is provided “as is.” We do not guarantee:

  • Uninterrupted operation of the Platform
  • A specific result (growth in followers, views, income)
  • Protection from sanctions by TikTok
  • The availability or conversion of KOTS loyalty points
  • The correct operation of payment providers (YooKassa)

KotKit’s maximum liability is limited to the amount you paid over the last 12 months of using the Platform. For more on risks, see the Risk disclosure page.

11. Termination of use

We reserve the right to suspend or terminate your access to the Platform in the event of a breach of these Terms, without prior notice.

Upon account blocking: funds with the status “pending” are forfeited; funds with the status “available” are subject to withdrawal within 30 days.

You may stop using the Platform at any time through your personal account.

12. Governing law and dispute resolution

These Terms are governed by the laws of the Russian Federation.

In the event of a dispute, the Parties undertake to make efforts to settle it through negotiations. A pre-trial claim is sent to legal@kotkit.pro and is reviewed within 30 calendar days.

If pre-trial settlement is impossible, the dispute is referred to the court at the location of KotKit.
